Delavan Lake Assembly Park - Notices

DLA - Assembly Hall Update
December 13, 2025

Dear Friends and Neighbors,

I hope that you are doing well and enjoying the Holiday Season!

I wanted to provide you with a brief update regarding the Assembly Hall project. Since our last communication, the Executive Board of the Assembly Hall Committee has been working extensively with our architect from ALA to develop a new design for the hall.

As stated before, the essential parameters for the design of the hall include the following:

  • To address the neighbors’ concerns over their view, and aligning with expressed concerns of members of the community, the current footprint on the Pottawatomi side will be maintained as is.
  • On the Assembly Lane side, we will square off the building, recovering the space that is lost today and allowing us to meet our identified storage and ADA restroom goals.
  • The new hall will be constructed with no accessibility barriers, including ADA compliant restrooms, accessible entry, and no steps within the main floor and patio area.
  • Adequate main floor storage will be provided for the tables, chairs and other large items.
  • The building will be located on the lot to maximize the views of the lake and park.
  • The main hall will be configured with sliding and/or decorative garage style doors providing the ability to easily expand the available space on both the lake and Pottawatomi sides.
  • The warming kitchen will be large enough to support current and future park events. The kitchen area can be secured, while still allowing full access to other areas of the building.
  • The garage area will adequately hold the park vehicles, with enough depth for the truck, plow and salt spreader attached.
  • The mailroom will be designed with mail slots for all residents, and shelving for the ever-increasing package deliveries. As an additional note, the executive committee did discuss in detail the potential of building a separate building for the mailroom but due to cost, security, and location concerns, did not feel it was in the best interest of the community to pursue.
  • Restrooms will be designed with two stalls each, one ADA accessible. One bathroom to be reinforced as an emergency shelter area from storms.
  • A basement except under the garage, allowing for additional storage and weather shelter.
  • The vision triangle on the northeast side will be addressed, removing all variances. With the parking issues previously addressed, the proposal should be variance free for permitting.

The Executive Committee has met several times, both on site and online, to look at various proposals, and to provide illustrations and examples that they feel best address the above parameters. They believe they have achieved this goal and have a building that they would like to share with the full Assembly Hall Committee now, and early in January, with a Question and Answer session with the full DLA community.

We will be having a full Assembly Hall Committee Meeting on Wednesday, December 17, at 7:00 pm. The purpose of the meeting is for the full committee to review the new plans for the Assembly Hall, to address any question regarding the work of the Executive Committee, and to discuss the next steps in presenting the new hall to the community. A separate communication will be sent out to all Assembly Hall Committee Members with a Zoom link for the meeting.

Through the Town and County Hearing process, some members of our community expressed interest in participating in the Assembly Hall Committee. We shared that new members would be welcome. If you would like to be included in this upcoming meeting, please send an email to Jim Ignoffo at njmpj@aol.com by Monday, December 15.

My thanks once again to all who have provided feedback and support through this process, My special thanks to Jim Ignoffo and Kathleen Fiedler and all members of the Executive Committee who have spent countless hours on this project.

Once again, Happy Holidays to All!

John A Glimco

DLA - Assembly Hall Update
November 2, 2025

Dear Friends and Neighbors,

Since our last communication there have been some positive developments with our objective to replace Assembly Hall.

We have continued our discussions with Walworth County and believe that we have come up with a solution regarding the parking requirements, line of sight and setback variances that were hindering our project moving forward. The primary concern was the parking issue and the requirement, based on occupancy capacity, of 1 parking space for every 3 individuals. In further discussions with the county, we were able to come to an agreement that the increased parking requirement would be based upon any proposed increased occupancy of the new hall. Keeping the requirements identified by the community in the forefront and working to address the concerns expressed through the variance appeal, we developed an enhanced set of design criteria that does not increase the hall occupancy and thus requires no additional parking but will provide a much-improved hall in both function and design.

With an available solution with the county identified, we enlisted ALA to take a new look at the project, working within these parameters:

  • To address the neighbors’ concerns over their view the current footprint on the Pottawatomi side will be maintained as is.
  • The building is located on the lot to maximize the views of the lake and park.
  • The main hall is configured with sliding and/or decorative garage style doors providing the ability to easily expand the available space on both the lake and Pottawatomi sides.
  • The warming kitchen is large enough to support current and future park events. The kitchen area can be secured, while still allowing full access to other areas of the building.
  • The garage area will adequately hold the park vehicles, with enough depth for the truck, plow and salt spreader attached.
  • The mailroom is designed with mail slots for all residents, and shelving for the ever-increasing package deliveries. As an additional note, the executive committee did discuss in detail the potential of building a separate building for the mailroom but due to cost, security, and location concerns, did not feel it was in best interest of the community to pursue.
  • Restrooms are designed with two stalls each, one ADA accessible. One bathroom to be reinforced as an emergency shelter area from storms.
  • A basement except under the garage, allowing for additional storage and weather shelter.
  • The vision triangle on the northeast side will be addressed, removing all variances.

The Executive Hall Committee will meet with ALA to develop a proposed floor plan that meets the above criteria. Once the floor plan is agreed upon, ALA will develop elevations. The elevations and floor plan will be reviewed by the full hall committee in advance of sharing them with the Assembly.

Originally, both the hall and the caretaker's home resided on one registered parcel. When this project was initiated, we were informed by the County that we must split the parcel into two separate properties. To officially register the split properties the county is requiring us to create a dedicated driveway on the caretaker’s property. This work is required regardless of the Hall decision and will be completed in the upcoming weeks.

With residential construction costs expected to rise 4%-8% in 2026, the committee will continue to work on this project with the goal of seeking Board and community approval this winter. We are now targeting a fall of 2026 start date for the project. One year behind our original target start date. Below is a proposed timeline for the project:

Week of October 20 - Meetings with AP Hall Executive Committee and ALA to discuss redesign. Once the floor plan is developed, ALA to produce elevations for the Executive Committee to review.

Week of December 1 - Floor plan and elevations are shared with the Hall Committee for review. Because of the results of the variance hearings many of the parameters are now non-negotiable such as footprint, accessible restrooms, garage depth, mailroom, and hall size. The objective of this meeting is to seek feedback on the exterior design and how to present the new design to the community and to discuss the overall positives and negatives of the new design.

Executive Committee and DLA Board to review the results of the Hall Committee Meeting with ALA

Executive Committee to contact original bidding contractors to re-submit “not to exceed” quotes based on new design – Due by December 31

Week of January 12- New plans and not to exceed costs to be shared with leaseholders at a Special Session Q&A meeting. Date dependent of receipt of not to exceed quotes.

Wednesday February 2 - DLA Regular Board Meeting. Included in New Business there will be a recommendation by the Hall Committee for the DLA Board to vote to approve the new hall design and to initiate a leaseholder vote. Also included on the meeting agenda will be a discussion and vote by the DLA Board on the first installment payment, if the new hall is approved by the Leaseholder vote.

February 21 - Voting concludes and results shared via email with the community

If Approved by the leaseholders:

Week of February 23 – DLA Board contracts Batterman to draft plat of survey for permits

Week of March 2 – Hall Executive Committee initiates gas and electric shut-off/new service agreements

Week of March 9 – Hall Executive Committee submits updated plans and survey to Walworth County to address denied variances

By January 31 – Finance Committee secures a lender and presents payment options to leaseholders

Week of February 23 - ALA contracted to draw final plans to secure formal builder quotes. Target date for completion March 30

Week of March 30 – Request for Quote sent to original bidding contractors to submit formal build proposals. Target date for completion May 15

Week of May 18 – Hall Executive Committee to review build proposals and prepare builder recommendation for DLA Board

Wednesday June 3 DLA Board Meeting - Committee to present builder recommendation for Board Approval

September 2026 - Weather/permit permitting, New Assembly Hall project begins

The above timeline is a proposal. There are a lot of dependencies, actual dates will be formally communicated to the community as the project progresses.

We will continue to inform the community through all stages of the project.

Sincerely,

John A Glimco
DLA Board President

Subject: Results of the 2025 Delavan Lake Citizen Survey

Dear Survey Respondent,

Thank you very much for participating in the 2025 Delavan Lake Citizen survey! I have enclosed (click here for the link) the results of the survey for your review.

As previously stated, our goal was to collect the thoughts and feedback of as many Delavan Lake stakeholders as possible, in an unbiased manner, and to provide that feedback to the Town of Delavan (ToD) in an unaltered fashion. Although some voices may not have been heard, either due to distribution issues or a lack of response, we are confident that this feedback and data will be useful to the Town of Delavan and other Lake advocacy groups.

We are anxious now to formally present and discuss your feedback at an upcoming ToD board meeting. That meeting has yet to be scheduled. However, we invite anyone who would like to assist in the planning of that presentation to reach out via my email address so we can include your thoughts and ideas on doing so. In any case, we are striving to have that presentation before the end of the year.

If you have any questions, concerns, or further feedback, please let us know! (gwdickow@gmail.com)

DLA - Assembly Hall Update
September 23, 2025

Dear Friends and Neighbors,

As part of our continued effort to keep you informed on our progress with the Assembly Hall Project, attached is the official notice from the Walworth County Board of Adjustment. You may remember that we were asking for three variances. In the attached decision, you will find that all three variances were denied. Below we have also attached a copy of an article from the Enterprise, reporting on the actions at the Town of Delavan. The Town of Delavan also recommended denying all three variance requests.

The vision triangle and setback variance requests can be addressed by a redesign. They are specific to the Pottawatomi side of the building. By addressing those issues, we believe that we would also be able to address the concerns expressed by community members specific to the adjacent property and potential impact on their view.

Specific to parking, there was no direct guidance or suggestion by either the town or county as to how we could address the required 93 parking spaces. There is no pathway forward with any rebuild unless we can get some relief regarding the required parking. I have begun the process of attempting to seek guidance and feedback at the County level by working with the Senior Zoning Officer. I have provided them with some suggested solutions and hope we can together find a solution that addresses their concerns, while meeting the needs of our community.

We will continue to share updates as they are made available and will discuss this further at our October Board meeting.

Thank you,

John A Glimco

DELAVAN’S ONLY LOCALLY PUBLISHED NEWSPAPER ALSO SERVING DARIEN
Board denies new Assembly Hall plans
By Michael S. Hoey
CORRESPONDENT

The Town of Delavan denied three variances filed by the Delavan Lake Assembly on behalf of the Assembly Park subdivision on Sept. 9. The variances would have allowed for the construction of a new Assembly Hall community building.

The Delavan Lake Assembly has been planning for a new hall since 2018. The new 4,104 square foot building would cost $1.25 million. Each leaseholder would pay $5,950 toward that cost.

The Delavan Lake Assembly first tried to get a permit from the Walworth County Land Use and Resource Management department. The request was denied on July 23 because the request needed three variances to proceed. The DLA requested the needed variances from the Town of Delavan, first appearing before the Plan Commission. The Plan Commission recommended denying the request by a 4-1 vote to the full Town Board.

The necessary variances included a request to have the street setback adjusted to 7.6 feet from Pottawatomi Drive, allow a raised patio and retaining wall higher than 2.5 feet, and waiving the requirement to have 93 parking spaces.

Katie O’Halloran, Treasurer of the DLA, said building a new hall has been a priority of leaseholders for years. A committee was created and a vote was taken to gauge support for the plan. O’Halloran said 54% of those who voted supported the plan. “As a board, we clearly received our mandate for how to proceed,” she said.

O’Halloran said that Assembly Park is unique and it was not a surprise the project needed to have variances approved. “While we would all like to keep the Assembly Park of yesteryear, we are evolving like our neighboring communities,” she said.

Chad Pollard, an attorney for a neighbor who is opposed to the project, said the project does not meet the qualifications for any of the three variances. Pollard said in order to qualify for variances the applicant must show unique property limitations, an unnecessary hardship and that the project will not do harm to public interests. Pollard said this project was a want, not a need. He also said the very building the Assembly claimed caused them a hardship has been in use all summer. Pollard said the plans were extravagant and the DLA could have planned a building that would have occupied the existing footprint and not needed any variances. He said the plans call for a 7,000-squarefoot building that will obstruct the valuable lake view of his client.

Greg Selep, DLA secretary, said Pollard was incorrect in claiming the new building is planned to be 7,000 square feet. He said it would be about 3,800 square feet. Paperwork submitted to the town says the building will be 3,752 square feet on the main level and 4,104 square feet total counting the basement.

Much discussion was had about the alleged lake view of the resident who hired Pollard and if the building was a want or a need. Tim Somen, an attorney representing the DLA, spoke about how the DLA is making do with what they have but the current buildingis failing, unsafe, and unsanitary.

Cheryl Kennedy opposed the new building. She said she and her husband do have a view of the lake that would be obstructed by this building. She said she knew the DLA had worked hard on the plan, but she wants it to remain within its current footprint.

Chairman Mary Knipper said the vote in favor of the new building was 101-86. She said she did not consider that to be a mandate, especially considering the number of letters the board received opposing it. Knipper also questioned why the DLA does not seem to have a Plan B if this plan does not get approved. She also suggested the DLA look at other locations to store things so the new building did not have to be so big.

Bill Thummel said he was not moved by the lack of a mandate. The vote was a majority and the majority wins, he said.

Knipper made the motion to deny all three variances. The DLA had requested that at least the parking restriction variance be granted because that will be needed no matter what is done. The board voted 2-1 to deny all three. Mary Pat O’Connor recused herself because she lives in Assembly Park and Hugh Charvat was absent.

Knipper did tell the DLA that the town’s decision was only advisory. The final word would come from the Walworth County Board of Adjustment. That body met on Sept. 10 and 11 and also denied all three variances.

DLA - A Message from the Assembly Hall Committee
September 13, 2025

To all Assembly Park Leaseholders,

After more than two years of meticulous planning, communication and consideration of the feedback received from the Leaseholders through a survey and due diligence, we regret to inform you that we have been denied the necessary variances to construct a new Assembly Hall.

While this outcome is not what we had hoped for, it is important that you are aware that the goal of building a new Assembly Hall was to create a space where our community could come together, socialize and feel a sense of pride and belonging. We envisioned a facility that would benefit the future generations and serve as a cherished legacy for our children and grandchildren. We were focusing on the future, not the past.

We acknowledge that not all Leaseholders shared our vision, and there were instances of disinformation regarding the committee and the proposed building. We want to assure you that our actions were transparent throughout the entire process and we were fully accessible to answer any questions or concerns you may have had.

We have had the privilege of collaborating with an exceptional group of individuals dedicated to enhancing Assembly Park. Their unwavering commitment to the greater good of the park was evident in their actions and they never prioritized personal gain.

We extend our sincere gratitude to John Glimco, Greg Selep, Brian Hatlen, Tom O'Halloran, Rob Mohr, Mae Mohr and Jeff Schultz for their invaluable guidance, support and professionalism throughout this entire process.

We also express our gratitude to the DLA Board of Directors and the Auxiliary for their unwavering support and dedication to the cause. Their professionalism and commitment to the best interests and highest good of Assembly Park are truly commendable.

To the finance committee, we appreciate your expertise and hard work talking to all the banks to secure the best possible financing for the hall.

To the Leaseholders who volunteered to serve on the full committee, we extend our sincere gratitude for your willingness to lend your time and insights to this project. It was a pleasure to witness a diverse group of individuals come together and try to accomplish a common goal for the benefit of the DLA.

To Chris Russo and his team at ALA Architects, we extend our appreciation for you exceptional expertise and professionalism. You worked closely with us to design a building that would fit well in our community and provide a gathering place for generations to come.

To Amy Lonergan our legal counsel, we appreciate her commitment and determination to help us with our legal challenges.

To all the contractors that we talked to, Adam Mohr, Mike O'Connor, IBC Building and Tristone Development. They all provided us with a cost estimate for the hall so the committee could then come up with a "not to exceed" number to build the hall.

As you can see, this truly was a team effort. We want to express our heartfelt gratitude to all who have demonstrated a common sense approach and unwavering dedication to Assembly Park.

With utmost respect,

Kathleen Fiedler and Jim Ignoffo
Co-Chairs, Assembly Hall Construction Committee.

DLA - Update on Assembly Park Hall project
September 12, 2025

Dear Friends and Neighbors,

A great deal has happened this week so I would like to provide the Assembly with an update regarding the New Assembly Hall project.

As a reminder, the three variances requested are listed below, along with the initial denial.

According to the plans submitted, you are requesting the following items:

To have the streetyard setback be adjusted to 7.6' from Pottawatomi Drive
A raised patio, retaining wall, and steps to be greater than 2.5' high within the 50' vision triangle To have four parking stalls for the building

The Walworth County Code of Ordinances has established the following ordinances:
Maintaining an established streetyard setback of 18.3' from Pottawatomi Drive Structures within the 50' vision triangle cannot exceed 2.5' in height
93 parking stalls for the building

On Tuesday, September 8, our variance request went before the Town of Delavan Board. We formally presented our case for the requested variances. The Board voted to deny our project, with a vote of 2 against, 1 in favor, and one abstaining. They voted to deny all three variances without providing specifics regarding the individual requests. The conversation centered around the Boards feeling that the project was to complex and that a 54% favorable vote to rebuild the Hall was not a “mandate” from the community.

On Wednesday, September 10, (link to the video - starting at 36:58) we met with the Walworth County Board of Adjustment. We again presented to the Board the rationale behind our requests for the variances, focusing on some of the points taken from the meeting with the town. There was a spirited discussion, with members of our community presenting their support and opposition to the project. Supporting comments stressed the need for an ADA accessible building, storage for chairs and tables, space to host the various functions held in the building and work and garage space for our equipment. Descending comments generally focused around the building size, the impact on the neighboring property, and the potential of separating the various functions of the current hall into separate facilities.

On September 11, the Walworth County Board of Adjustment denied all three variances. (link to the video - starting at 15:49) Again, they did not provide specifics. They did echo the opposition claim that the Hall is a “want and not a need”. To the most critical issue, the required number of parking spaces, they simply stated we need more parking spaces than the four identified in the plan.

I will be reaching out to the County to see if they can provide more specifics to address the issue regarding parking. If they remain firm in upholding the current county code of one parking space for every three individuals as defined by building occupancy a path to move this project forward may not be possible. This is critical to determine before investing further time and funds towards this project.

If a clear decision or at least guidance can be provided by the County that allows us to address the parking needs in a sensible way that the community can support, we will consider reconvening the Assembly Hall Committee to explore options. If not, a decision will need to be made as to what to do with the building and property.

A few individuals expressed publicly that we should have been aware of the county requirements before we ever proceeded with any planning. The fact is, we were quite aware of the building issues and had met formally with County staff prior to proceeding with any drawings and plans. In those meetings and following discussions they recognized the uniqueness of Assembly Park and encouraged us to proceed through the formal variance process so we could explore what might be approved to meet our identified needs. As I have shared before, we were surprised by how they are classifying our building and the parking issues, none of which were raised in prior meetings with the county.

If we choose to move forward, a building redesign that addresses all the identified concerns, new project quotes from builders, and a full vote from all leaseholders will be required. We will need to reform the Hall Committee. We will once again open the committee up to all members of the community to engage in this process. Since it is apparent that we need a “mandate” from the community we cannot move forward unless those currently in opposition steps up and take active roles on the committee.

As we have tried to do in the past, we will continue to keep all members of the community involved and informed on each and every step.

Once again, my thanks to all the members of our community who engaged in the process, either through their participation and leadership on the committee, through their participation in the many meetings, through letters shared, both for and against, and for engaging in the voting process. It has been a long journey, and one that we hope continues. As always, I remain grateful for the opportunity to be a member of this community, and the opportunity to serve.

Sincerely,

DLA - Hall Project Recap
September 6, 2025

Dear Friends and Neighbors

At our September DLA Board Meeting, held on 9/3, we presented the community with an update regarding the status of the proposed new Assembly Hall, results of the meeting with the Town of Delavan Planning Commission, and entertained several questions and comments from our leaseholders. The meeting in its entirety is posted on our website.

I wanted to provide a brief recap regarding the project and the upcoming steps as we proceed through the various stages of obtaining approval for the proposed new hall.

When the project plans were submitted for approval to the Walworth County Board of Adjustment, we received a letter stating that there were three items that would require an approved variance. As stated, these are:

  • To have the street / yard setback be adjusted to 7.6' from Pottawatomi Drive
  • A raised patio, retaining wall, and steps to be greater than 2.5' high within the 50' vision triangle
  • To have four parking stalls for the building

The Walworth County Code of Ordinances has established the following ordinances:

  • Maintaining an established street / yard setback of 18.3' from Pottawatomi Drive
  • Structures within the 50' vision triangle cannot exceed 2.5' in height
  • 93 parking stalls for the building

We have prepared and submitted an appeal, following county guidelines, to specifically address these three items. We are challenging the point of measurement and distance on Pottawatomi. We believe that the measurement is being taken from the plate of survey and not where the street actually is. The need for the rase in the patio is to maintain ADA access to the facility. The number of parking spaces identified as a requirement for the structure (93) is based on a county ordinance of 1 parking space for every three potential occupants and does not consider that the Hall is for resident use only and that we are primarily a walking / golf cart community.

The County looks to recommendations from the Town in considering the variance request. This past Tuesday, we met with the Town of Delavan Planning Committee. Their recommendation will be presented at the Town of Delavan Board Meeting and then forwarded to the Walworth County Board of Adjustment for consideration in their decision on the three variances.

The Town of Delavan Planning Committee meeting was well attended by individuals from our community, both in favor of and against the project. I received a packet of additional letters that were presented to the Board in recent days. These letters were equally split in their support. At the request of the Commission chair, if letters were previously submitted to the Board, they were requested not to speak, as their concerns were noted. No additional speakers presented at the allocated time in the meeting agenda. An exception was made for the opposition lawyer hired by one of our leaseholders who came in late. He was allowed to present for three minutes.
The vote of the committee for the requested variances was: 4 against, 2 abstaining, and 1 in favor. This is the recommendation that will be forwarded next week to the Walworth County Board.

The main objections by the Planning Committee did not center around the specific variance requests but seemed more responsive to the concerns raised by the objectors.

Probably, the strongest statement by the Planning Committee was that the results of the DLA approval vote for the hall did “not signify overwhelming support from the community”. Although the hall was approved with 54.1 % in favor, 101 for and 86 against of the 211 leaseholders, they did not consider this to be enough of a mandate.

They questioned why we did not consider relocating the mailroom to a separate, standalone facility. They also focused on the current garage at the top of the hill, but after some discussion seemed accepting of our responses to the limitations of this property and the safety factor if using North Shore drive for access and egress.

They also expressed concerns with the loss of views by the adjacent property.

I am grateful to the Town of Delavan Planning Committee and for the opportunity to meet before them. They were highly professional, respectful to the needs of all members of our community, and supportive through the process.

The rational and vote of the Planning Committee will be shared at the Town of Delavan Board Meeting next Tuesday, September 9 at 6:00 pm. We anticipate that the Town Board will align with the decisions from their committee and recommend to the county not to approve the variances.

However, it is essential that we continue through this process with Walworth County and have the variance requests specifically addressed, with recommendations to resolve them. This can only occur at the county level next Wednesday. If the variance for the parking requirement is not granted it would prevent this or any other replacement hall from being built in our Park,

When asked by the Town Planning Committee “what “Plan B” is for the hall”. I replied that I did not know. We need specific answers to these variances for this or any new structure to be considered by our community.

The Walworth County Board of Adjustment will meet next Wednesday, September 10 at 9:00 am. They will provide their judgement on the variance request on September 11.

We would like to thank the large number of leaseholders who participated on the Hall Planning Committee and the great response of 88.6% of leaseholders who participated in the approval voting process.

We are aware that there is a campaign encouraging individuals to write to the Walworth County Board of Adjustment to express their objection to the project. It is important that everyone’s opinion be heard. Many individuals on both sides of the proposed new hall have already submitted letters to the County. However, if you would like to share your thoughts for the consideration of the Walworth County Board of Adjustment, they can be addressed to:

Correspondence:

Wohlberg
To all Board Members,

I want everyone to understand that I am not accusing anyone of anything. I don't think anyone ran off with the Auxiliary money.

I am questioning the accounting of the money. I am aware that Arbor Day is not a fundraising event. However, if we don't know the cost of each Arbor Day event, how will we know if we are charging enough to cover those costs? Should we charge more or less for pony rides, bags tournament, etc. Without proper accounting of income and expenses for each event, how do we know if Arbor Day broke even, lost $5,000 or made $5,000. We don't know, and if we are losing money, we need to fix it by charging more for those events. If the latest P&L is correct, we lost over $4,000 last Arbor Day. Why? What events cost more than the income they generated? We need to know this information in order to break even.

And, this is true for all events: golf tournament, ice cream social, spaghetti dinner, pancake breakfast, etc.

If the Auxiliary doesn't keep track by event and only looks at the annual totals, we will be unknowingly subsidizing unprofitable events and our losses will continue to grow. That is what I am trying to get across. We can't continue operating in the blind. The latest P&L for the Auxiliary, if accurate, shows a loss of over $22,000 last year. According to the 12/31/2024 Balance Sheet, we have less than $17,000 in the checking and money market accounts. We can't have another $22,000 loss this year. We need accurate accounting.

All I did was ask questions that, as a leaseholder have every right to ask and I can’t get specific answers from anyone.
So you have a little bit of my background, I was the treasurer of the Ladies Auxiliary from 2010 to Oct of 2017. I was the secretary of the Assembly board for 3 years and stayed on for another 3 years. I also ran Arbor Day for about 7 Years, so I do have a little experience with all of the doings of the park.

Greg forward to Allison since I do not have her email address.

Regards,

Cindy Wohlberg

To: Cindy Wohlberg From: Katie O’Halloran on behalf of the DLA Board & Auxiliary Board
Date: July 12, 2025 RE: Questions on Auxiliary Financials

Hi Cindy,

Thank you for your emails dated June 27 and July 10. Below are responses to your questions, and I am happy to meet in person when I am up next week at the lake to discuss further.
Let me start by saying that I have reviewed the Auxiliary financials and support and spoken extensively with the treasurer. Based on that review and our conversations, I have no concerns regarding the accuracy or reporting of their financials.

Fiscal Year and Treasurer Responsibilities

You’re correct that the Park’s fiscal year is May 1 to April 30, and the Auxiliary follows the same. The P&L presented at the last meeting mistakenly said it was January–December 2024, but that was an error and has since been corrected. 2. Donation Line Item ($4,510.86) This amount reflects donations made by the Auxiliary to the Park, including items like recycling bins, beach trampoline, and materials for park benches.

Retained Earnings

It sounds like there may have been confusion with the document referenced. The opening balance for retained earnings was $38,976.14, and the FY 2024 net loss of $22,271.35 brings the ending balance to $16,704.79.

Bank Transactions in P&L

I did not see where the banks were that you are referencing. However, there are multiple ways you can handle banks. Classifying a bank you give for an event as an expense, and what you get back as income is an acceptable practice.

Miscellaneous Accounts

The presence of two similarly named accounts—one with a period and one without—is likely a result of system transitions like QuickBooks updates. One account has a zero balance and no active transactions.

Net Operating Income vs. Net Income

These figures are the same because no adjustments or items exist between operating and net income in the current format.

Non-Profit Status

To the best of our knowledge, the Auxiliary has never held 501(c)(3) status. It doesn’t engage in activities that would meet the criteria for charitable designation. If you have documentation indicating otherwise, please share it.

Request for Audit

While your intent isn’t to question anyone’s integrity, I appreciate your concerns about the accounting format. I’ve thoroughly reviewed the Auxiliary’s financials, spoken with the treasurer, and can confirm that the Auxiliary has maintained transparency through consistent monthly financial reports. Both the DLA Board and the Auxiliary Board are fully comfortable with the accuracy and completeness of these Quick Book reports and supporting documentation
Each treasurer brings a slightly different approach, and while current practices may not align perfectly with those used in the past, they are valid and appropriate for the organization’s needs.

Regarding your email from July 10:

The FY25 loss was primarily due to funding the new pickleball and basketball courts, which had been a multi-year fundraising effort. This included a $10,000 donation from a leaseholder, along with several years or fundraising dollars from the Auxiliary. Recording the expense in the year the courts were built impacted that year’s totals. Other tracking methods could have been used, but this approach worked well for the current team. Absent that $33,000 investment for the courts, the net income for the year was approximately $11,000.

You’ve contributed greatly in the past, and that’s appreciated. However, the current Auxiliary Board makes its own decisions, including how it tracks events like Arbor Day. While Arbor Day technically showed a loss overall, the Auxiliary still generated income through donations and AP merchandise sales, among other things. The modernization of how the auxiliary operates has come with great success, making it easier for people to spend money, reducing the amount of cash needed at events and protecting us better from fraud. But it also has its challenges. Payments received through Square and Zelle may be for multiple things, like clothing and Arbor Day tickets, so while it may not be categorized to the penny, it’s all accurately reflected as revenue. Detailed event tracking is labor-intensive and may be impractical with limited volunteer support.
In summary, the Auxiliary’s financials are accurate and reflect intentional decisions by the current team. While their approach may differ from yours, it’s valid and tailored to their current capacity. They’re fully aware of available funds and are managing future spending responsibly.

Best regards,
Katie O’Halloran DLA Board & Auxiliary Board

Hi Tom, Lisa and Glen,

A Leaseholder sent me the attached picture and video of significant amount of mud that has washed away from your new home onto Potawatomi Drive. I know there has been a lot of rain and perhaps the grass seed hasn't had a chance to take hold. However, the problem needs to be addressed so this doesn't keep happening. Maybe installing a silt fence or temporary berm until the grass has a chance to get established?

Please let me know if you have any questions and I appreciate your help in keeping this from happening again.
Thank you,
Jim

DLA - Assembly Hall - Rumors vs Facts
July 10, 2025

Dear friends and neighbors

We are aware that although a majority of us are in favor of rebuilding Assembly Hall there are a few who are not. It is unfortunate that this group has decided, yet again, to spread misinformation about the proposed Assembly Hall. We would like to take this opportunity to dispel those rumors.

Rumor: "The drawings in the mailroom are not the current Assembly Hall drawings".
Fact: The drawings in the mailroom are the same drawings that were presented to the Leaseholders at the special meeting in January and are the same drawings that were voted on and approved by a majority of the DLA Leaseholders. They have not changed.

Rumor: "The fireplace is giant and real"
Fact: If the fireplace remains in the final design, it would be electric. Therefore, it would not require venting, has no combustible material, is safe to operate and would be on a timer.

Rumor: "The building will go into the caretaker’s yard and block their view"
Fact: The approved building is a 3877 sq ft single story structure. The proposed 2018 building was a two-story structure and 5593 sq feet. The west wall, which is the source of the opposition’s objections, is 66 feet long, 2 feet shorter than what was proposed in 2018. The 2018 building would have extended into the caretaker's yard. The approved 2025 building will not block the caretakers' view or the view from the backyards of most of the houses on Assembly Lane.

Although we respect the opinions of the minority view on the Hall we must point out that the leadership of this group chose not to participate on the Hall Committee, did not take part in the requirements gathering or design sessions and did not attend the monthly meetings where the results were socialized and discussed. Other than one leaseholder who believes that their view of the Park, down their neighbor’s driveway, will be blocked, the minority group has not articulated why they oppose the proposed design and at no time in this two-year process has this group offered an alternative.

This is an important project for the community and like all important decisions it must be based on facts. This is why the Hall Committee has reported out at every monthly meeting since September of 2023. DLA - Delavan Lake Citizen Survey - Please Take a Moment and Participate
July 9, 2025

Assembly Park,

A group of citizen supporters and stakeholders of Delavan Lake has created a survey that intends to collect the thoughts and feedback of folks like us regarding the water quality, safety, and recreational standing of Delavan Lake.

Survey results will be collected and presented to the Town of Delavan board (hopefully) in the August-September time frame. The Town of Delavan is responsible for both the identification and mitigation of issues concerning Delavan Lake. If you choose to participate in the survey, you will be given an option to receive the results via email in advance, as well as notification of the presentation date.

It is important to note that this survey does not advocate for any specific agenda and only strives to provide a collective voice to those who love and use the lake!

We hope you will participate in the survey to maximize the potential consensus value and utility for the Town of Delavan.

Thank You,

Assembly Hall Update
In case some of you were not able to attend the May Board of Directors meeting, we wanted to give you an update on the progress of Assembly Hall.

The Board of Directors has contracted with R.H. Batterman to provide us with a new plat of survey for Assembly Hall and the Caretakers' house, which has been completed. In order to proceed with the permitting process, Walworth County has required us to split the tax parcel separating the Caretakers House from Assembly Hall. That paperwork has been filed with the county.

Also, the paperwork will be filed for the necessary permits. At that time, we should have a better idea of when we will be getting on Walworth County's Board of Adjustments agenda for the required variances.

We will keep you informed as more information becomes available.

Thank you,

Kathleen Fiedler and Jim Ignoffo

Thank you to all who attended the Auxiliary meeting last night!

We are more than willing to help out! Feel free to make it your own as well. It doesn't need to be spaghetti dinner, it could be tacos, or hot dogs and brats.

DLA -South Entrance Update
May 8, 2025

Hi everyone,

Keeping you updated on the masonry work at the South Entrance. I talked to HD Masonry today; he said the South Entrance will be ground out and tuck pointed by the end of this week (possibly working the weekend). On Monday he plans to remove the top caps and pour new ones. From there he will move to the North entrance to begin grinding out the old mortar. He plans to grind out more than we originally talked about because he wants everything to look the same as possible.

DLA - Assembly Hall New Construction Approval - Vote Summary
February 9, 2025

Fellow leaseholders, friends and neighbors

On Friday, we closed the special vote on the new construction approval for Assembly Hall. This vote is the result of a year and a half effort by our Assembly Hall Committee. 33 residents volunteered their time and skills to: gather requirements, find an architect, work with that architect to develop a design that meets the needs identified by the community, and to develop cost estimates. Twice this committee voted to recommend moving forward with this once in a lifetime project.

The design and floor plans were presented to the community in multiple monthly meetings. Renderings were posted in the mailroom and throughout the process all the documentation has been posted on the website.

On January 15th the Board called a special meeting and the committee reviewed the process and presented their cost estimates. 100 residents attended. To ensure all questions were answered the Board held an additional Q&A session on January 29th attended by 79 residents

Of course, no effort of this size and scope is going to gain unanimous approval and there certainly have been compromises along this journey that started in 2018. Over the weekend the votes were counted. 187 of our 211 leaseholders voted (88.6% ) with 101 voting “Yes – I vote to approve rebuilding Assembly Hall pursuant to the building drawings presented to the Leaseholders at the Special Meeting on January 15, 2025” and 86 voting “No - I am voting to not approve rebuilding Assembly Hall”. With this result the board has instructed the Assembly Hall committee to move forward and prepare for the town and county variance hearings.

The Board would like to thank everyone who participated in the multiple meetings and expressed their opinions. We would like to thank the committee for their efforts and countless hours of work. And we would like to thank everyone who voted.

We hope with this decision we can begin to unite around this project as a community. The time for second guessing needs to be behind us. Our success is dependent on moving forward together as an Assembly.

Sincerely

DLA Hall Committee

DLA Board of Directors

DLA - Assembly Hall - New Construction Approval - Reminder
January 30, 2025

This morning a reminder email was sent to anyone who is registered to vote electronically and has not yet voted. The email will come from: kkempaccounting@yahoo.com via surveymonkey.com with a subject line of: DLA – Assembly Hall – New Construction Approval - Reminder - Please Vote. If you do not find this email in your in-box please look in your junk and or spam folder.

Voting will remain open until 5pm on February 7

Last night, a Q & A session was held via Zoom. 78 residents attended. The meeting minutes and recording will be posted over the weekend. It was a very healthy and productive exchange. If you still have questions please send them to: gselep618@comcast.net

If you are a member of a multi-owner property, please reach out to your voting member and express your opinion.

We thank everyone who has taken the time over the last year and a half to attend these meetings and become informed on this important decision. We would also like to thank the 33 leaseholders who volunteered their time to participate on the "Assembly Hall Committee" and their hard work: to gather requirements, find and select an architect, review drawings and renderings, gather quotes from builders to estimate costs and make multiple presentation to inform the Assembly.

The issue of what to do with the hall started in 2018 (7 years ago). It's time to make a decision. Your vote is important.

Thank You and Please Vote

DLA - Response to Community Member’s Email RE: Proposed New Hall
January 24, 2025

image

The DLA Board has been made aware of a series of emails that are being circulated to select members of the community regarding the proposed new Assembly Hall from a former member of the Board.

Everyone has their right to express their thoughts regarding this project, in fact we encourage this dialogue and discussion so all can be best informed. We have recently sent out a FAQ document to all leaseholders addressing some of the questions raised about the project, and we are hosting an open Question and Answer meeting with the Assembly Hall Committee and Board on January 29th to further provide our community with opportunities for dialogue.

However, we are concerned as these communications are being sent out to what appears to be a broad group of leaseholders, with falsehoods being presented as facts. The individual coordinating this effort has not once reached out to the committee or Board directly with questions or concerns. We were presented with a copy of the communication by a concerned leaseholder, worried about the misinformation. We, the current Board and members of the Assembly Hall committee, felt it important that we address the key points with some factual information.

In the communication, it was stated that “our Board of Directors is woefully unqualified and very inexperienced in construction projects” and “has little to no experience with the planning and coordinating of a public building”

Response: This statement does not take into account the previous and professional experiences of the Board and the Assembly Hall Committee members. Participation in the Assembly Hall Committee was open to all leaseholders, garnering a wide range of personal and professional experiences valuable to the project.

One of the primary members of the Assembly Hall Committee, leaseholder Brian Hatlen, President and Owner of Troop Contracting, Inc., has been highly instrumental in leading the process. Among Brian’s credentials, previously shared at the initial presentation for the project includes major Chicago buildings and structures, including a redesign of the Shedd Aquarium. His firm does over $45M in revenues annually. He offered the following statement in response to the comments:

“I have been doing Architecture and General Contracting for 25yrs. This is exactly how the process should work. Establish a design-to budget (Not-to-Exceed), get the budget approved, and then move forward with the rest of the design, with the cost of the rest of the design included in the project budget.

This is NOT a typical project that would make sense to a typical layperson. Most people would incorrectly assume this process should be exactly like building a house or residential addition. With a house project, you select and pay an architect to do the complete design (100%), then you bid it out for hard bids. It is very straightforward, you put your trust in an architect to design to your budget. You can’t do that here because we have a community of 211 leaseholders, and we simply can’t get to 100% without a vote, nor can we pay $35k to have a full set of FOR CONSTRUCTION DOCUMENTS together needed for hard bids.”

In addition to Brian, Jeff Schultz, a degreed architect working in the field, also offered key insights towards the development of the new hall. We feel quite fortunate to have individuals like Brian and Jeff, and the other professionals on the Committee to provide guidance in both the development and financial aspects of this project. If the Assembly votes to move forward with this project we will be hiring an experienced general contractor and form a committee of board members and leaseholders to help manage the project and ensure that we stay on time and budget.

Another statement presented that we take a strong objection to is, “Our Board gave us three estimates from contractors, but these are not written estimates, but rather non-binding guesstimates….”

Response: What we asked for and received from our contractors was realistic budget numbers in writing (not guesstimates), with several of the quotes going into great detail regarding all phases of the project, from demolition and permits to landscaping. We were specific in what we asked of the contractors. It should be noted that 4 of the 5 contractor’s had very similar estimates, as reflected in our presentation. We discarded one proposal for concerns that it was non-specific and vague without supporting information to back up the quote. Each contractor was provided with the plans and documents to make an informed and accurate proposal for the project. We are well beyond what would be called guesstimates. A realistic number is essential in order for the Board to bring this in front of the leaseholders for approval, with a “not to exceed” projected budget.

Full construction documents have not yet been contracted, nor are they essential for this phase of the project. We will not proceed with this cost until we receive approval from the leaseholders, approval from the town of Delavan and variance approval from Walworth County.

Another statement by the author: “I suggest that once legitimate, written estimates come in and all of the associated costs are included, the price will be 2 million dollars and each leaseholder can expect a special assessment of $10,000 and not $5,000”.

Response: It is important to note that the author offers no explanation on why he believes this project will have a $750,000 overrun. We showed the facts, and we established a NOT-TO-EXCEED cost based on the estimates we received and the establishment of a contingency. We have designed to that cost and have stated in the presentation that compromises in the design could be made if needed to control the costs. The community is being asked to vote on this “not to exceed” budget.

The author also stated: “Our Treasurer expects to get a bank loan for those Leaseholders who wish to stretch out their special assessment over a five year period. That will never happen.”

Response: Our Finance Committee, consisting of individuals with significant commercial lending and banking experience have been in direct discussions regarding this issue, and will enter into more serious conversations once the project is approved and the amount to be financed is known.

There was a statement posed by the author that: “Our Board made no mention of a surety bond and this cost is at least $20,000. A surety bond is essential to protect our Leaseholders investment.”

Response: The Board presented to the community overall costs for the project, not a line-by-line budget proposal. This issue and other similar items have been discussed and will be addressed. For those unaware of what was being raised in the question, Brian Hatlen provided the following, “What is referred to here is Payment and Performance Bonds (2 actual documents, but typically are executed together). A surety company (e.g. CNA, Northwestern Mutual, Travelers, etc.) will provide Payment and Performance Bonds on behalf of the awarded GC.

These are required only at the Owner’s discretion, and there is a cost that the GC will add to the overall cost of the contract. Depending on the GC’s standing with the Surety, the range is typically 1%-2% of the total cost of construction

Payment Bond says that the Surety will protect the owner from GC default on paying its subcontractors

Performance Bond says that the Surety will protect the owner from the GC default on the overall performance of the contract

If a GC defaults, e.g. goes out of business, the Surety steps in and finishes the project at no expense to the owner. Stated simply, the Surety will hire a new GC and the project will get finished.

There is also what is called a Builder’s Risk Policy, which would also be a good thing. It is typically cheaper than the Payment & Performance Bonds, but protects the new work (during course of construction) from Acts of God (tornado, flooding, fire, etc.)

Brian has recommended that a Payment and Performance Bonds and Builder’s Risk Policy be part of our agreement with a general contractor.

The author also states that, “……Capt. Ed Butzirus (1608 Assembly Lane) has advised the Board that the proposed structure’s footprint will completely block his view of the Park & the Lake and that he has retained legal counsel to block this project from moving forward. He will do this and the Board has been advised of this several times. They have completely ignored his cautions.”

Response: This issue has been addressed in open forum at Board meetings and in direct meetings with the Butzirus family. In fact, the leaders of the Assembly Hall Committee met directly with representatives of the family before any plans were shared with the community to listen to and best address their concerns. In addition, members of the committee met with Capt. Butzirus to hear his concerns, explain our rationale for the structure, and to share adjustments already made in concern for the family. From these conversations, items such as relocating the HVAC system and design improvements on the west wall have been made.

Our architect originally presented plans that were significantly larger than the current building design. Although this plan was within the buildable footprint and would not require a variance they would have been a greater obstruction to the Butzirus family. This design was immediately rejected by the committee out of concern for the Butzirus family and other neighboring properties.

The committee and board have worked to develop a mutually beneficial design that meets the identified needs for the community and fits the look and feel of the Park We are working with legal advice and counsel to best address this issue through the variance process.

It is interesting to note that the previous design for the hall, promoted in 2018 while the author was an Officer on the Board, was larger in size and a greater obstruction in width and height to the property at 1608 Assembly Lane. That design was developed without prior notice to the community, nor approval for the expenditures for the preliminary designs. The proposed structure was two stories, with the second floor identified as a board room, complete with an elevator and deck.

The author also speaks in general terms for the community, stating, “We, the leaseholders, don’t want to spend $35,000 for building prints for a structure that will not be built.”

Response: We do not wish to waste valuable resources of our community and will not spend funds for engineering drawings until the project is approved by our leaseholders and then approved at the Town and County level. Then and only then would the full construction plans be contracted. We do feel, if approved by the community, this project will move positively towards completion.

In the communication, the author points out the issues with the technology and viewing capacity of the Special Meeting.

We have already publicly apologized for this inconvenience. We have also made the recording of the meeting, the presentation and related documents available for all members of the community. We have created a Frequently Asked Questions document from the questions asked at the Special Meeting and we will be hosting a Question-and-Answer meeting for all leaseholders to participate in on January 29th.

We hope that this communication has provided some clarity to the issues and questions the author’s statements have raised. We encourage you to attend the January 29th meeting to share your thoughts and questions in advance of making a decision regarding the proposed new hall for Assembly Park.

In conclusion, the Board of Directors took on this project in response to the overwhelming sentiment from the majority of leaseholders that the Assembly Hall was of paramount importance. We ensured the Assembly Hall committee was inclusive and accessible to all leaseholders, fostering a collaborative and open approach. Throughout this process, we have continually strived to address the concerns and needs of our community, reaffirming our commitment to creating a functional space while maintaining the character of Assembly Park.

Sincerely

DLA Board of Directors

Votes will be counted on February 7 at 5pm and reported to the community on February 10.

We will also be hosting another Question and Answer session on January 29th at 7pm via Zoom

Thank You

FYI - This morning the attachments and email below were sent to the primary "voting" leaseholders. I am forwarding this communication as information only.

Please remember that voting is by the voting leaseholder and is one vote per household.

Thank You
